Long Island Railroad train accident injured tens of passengers

New York – This week’s train collision involved a passenger commuter train and a maintenance train. Long Island Railroad (LIRR) officials reported that there were approximately 600 passengers on the train at the time of the crash. The initial investigation reveals that the maintenance train got in the way of the commuter one as it was traveling on a nearby track. The closer-than-normal proximity of the 2 trains caused the train accident and led to the train derailment. As the trains collided and then derailed, victims were sent flying in all directions. Emergency responders reported that at least 33 accident victims were injured in the train crash. The injured people were extricated from the wreck and evacuated to area hospitals.

Commuter safety specialists and passengers alike have expressed their outrage. They complain that the train companies must tighten their safety standards to prevent such tragic accidents. They note that vehicles as large and fast as a train require the highest level of safety and accident prevention. Some have contended that safety enforcement has become too lax and has led to negligent maintenance of the equipment. They also warn that engineer drivers often speed and disregard safety directives. Multiple car crash pile-up in Staten Island being investigated

New York – As many as twelve vehicles were involved in a horrific car accident in a busy Staten Island intersection. Police believe that the multi-car pile-up began when an elderly woman crashed her car into a pick-up truck on Victory Boulevard at a traffic light. Witnesses note that the senior citizen was speeding through the intersection when she lost control. This set off a chain reaction where her car then slammed into additional vehicles at the red light, causing more cars to crash into one another as well. The woman suffered a severe head injury and subsequently died in the hospital. One of the vehicles that the elderly woman’s car hit was an SUV being driven by a 75-year-old man. That SUV driver died of the injuries from an accident, according to emergency responders. Officials note that at least 12 other accident victims were injured in the incident and received emergency treatment. Several of those injury victims have been listed as suffering with serious or even critical wounds.

One of the things that has road safety experts concerned is that the intersection was a known hazard zone, so the speed limit was lowered to only 25 miles-per-hour and designated as a “slow zone.” However, some believe that at least some must have been speeding cars or reckless driving, as evidenced by the severity of the collisions and damage to the cars. Are Suffolk County’s red-light cameras causing more accidents with injuries?

New York – Public safety activists are in an uproar about an ongoing investigation that shows an increased accident with injuries risk at intersections equipped with red-light cameras. Lawmakers and citizens alike have expressed concerns regarding the dangerous condition created by these traffic light cameras. They note that some of the traffic signals have faster-than-normal yellow lights and confusing signals, creating a risk for injury due to car accidents that inevitably follow. In the meantime, Suffolk County officials claim that the camera program is fine and plan to continue with it, despite the public safety concerns involved. Opponents question why the program isn’t suspended until they, at least, investigate the increased car crash concerns. They explain that this would allow the time to safely look into the issues and prevent injury or wrongful death accidents. One theory as to why there is an increased accident risk at these intersections revolves around concerned motorists who become afraid of getting a ticket, instead of remaining focused on driving safely. MTA bus accident in Midtown leaves multiple injuries in its wake

New York – Yesterday’s Metropolitan Transportation Authority (MTA) bus crash led to at least nine accident victims receiving emergency treatment of their injuries. Several of the injured passengers refused transport to a hospital but may require medical care at a later date. The bus driver admitted to losing control of the bus and crashing into a support pillar of a highway overpass bridge above. The questions regarding why and how the driver lost control remain the focus of the investigation. Police and MTA officials were looking into the cause of the accident, including a check into the driver’s safety record and accident history. They have received eye-witness reports that he was a distracted driver, possibly reaching to get a bottle when the motor vehicle collision occurred. The crash occurred near a curve in the road which may been a factor in the incident. Further scrutiny of this accident with injuries must include evaluation of the mechanical condition of the bus itself. Investigators will need to look at the repair and maintenance records for the vehicle to determine if it was safe for public transportation use. $362,500 in Total Settlements For Pedestrian Accident Victims

New York — Two pedestrians were crossing the street when one of them was hit by a car and the other nearly struck by the vehicle. The driver of the car claimed that he skid on snow. The injured accident victim suffered broken bones, including a pelvic fracture, leg fracture and broken shoulder bone. At 7 AM on 12/6/97, the 72-year-old Plaintiff A was walking with her daughter, Plaintiff B, on State Hwy. 36 in the Town of Groveland. There was snow on the ground from an earlier storm. Plaintiff A was crossing the highway when she was struck by Defendant’s vehicle. Plaintiff B avoided the accident, but contended that she had been in the zone of danger. Defendant contended that the Plaintiffs initially had been waiting by the yellow line, then darted into the roadway. Defendant also claimed that the snow on the roadway caused his vehicle to skid.

Injury:

Fractures to the right pelvis, fibula, and tibia; fractured left nondominant shoulder. Plaintiff A received physical therapy from the date of the accident until 4/16/98.

Note: Defendant won a motion to move the trial to Livingston, based on the fact that the police officers were witnesses who would be called to testify at trial and were from that venue. Plaintiff showed in renewal and reargument that the police officers were not necessary witnesses in that they did not do an actual reconstruction of the accident scene and were willing to travel to Queens for trial. The case was subsequently moved back to the Queens venue.

Result:

This action settled at the beginning of jury selection for $300,000 for Plaintiff A and $62,500 for Plaintiff B.

Facts:

At about 8:45 p.m. on Jan. 9, 2013, the plaintiff, a 14-year-old boy, was struck by a motor vehicle. The incident occurred on Woodmere Boulevard, alongside its intersection at West Broadway, in Woodmere. The victim was tossed onto a sidewalk, and he sustained an injury of his head.

The teenage boy’s mother, acting individually and as his parent and natural guardian, sued the vehicle’s driver. The plaintiffs alleged that the driver was negligent in the operation of his vehicle.

The victim acknowledged that he ran across the roadway, but he claimed that a green traffic signal permitted his entrance to the roadway. He further claimed that the signal remained green the entire time that he was on the roadway. Thus, plaintiffs’ counsel contended that the boy possessed the right of way.

The boy also claimed that he had crossed all but 3 or 4 feet of the roadway when the impact occurred. Plaintiffs’ counsel contended that the driver should have seen and avoided the pedestrian. An eyewitness claimed to have sounded a vehicle’s horn, to warn the driver and pedestrian, but that neither party reacted. The car driver suffers a cataract and experiences deficits of his audition, and plaintiffs’ counsel contended that the driver should not have been operating a motor vehicle.

The teen suffers a congenital defect that impairs his right ear’s audition. His right ear would have been the one closest to the vehicle that hit him and the witness’s vehicle. The defendant claimed that he stopped at a red signal upon reaching the intersection. He further claimed that the pedestrian boy entered the roadway after the signal had turned green.

Injury:

The pedestrian accident victim sustained a fracture of his skull. He was placed in an ambulance, and he was transported to Nassau University Medical Center, in the hamlet of East Meadow. He underwent an immediate craniotomy, which involved removal of extruded fragments of his skull. His head’s wound was closed via application of staples.

The victim claimed that his injury prevented his attendance of two weeks of school. His doctors have advised that he should avoid activities — such as skiing or playing football — that could result in an injury of his head.

The boy’s mother sought recovery of damages for his past and future pain and suffering. She initially presented a derivative claim, but her claim was not pursued.

Defense counsel contended that the boy recovered within two weeks of the accident.

Result:

The parties negotiated a pretrial settlement. The defendant’s primary insurer tendered its policy, which provided $250,000 of coverage, and the defendant’s excess insurer agreed to pay $250,000. Thus, the settlement totaled $500,000.

Pedestrian accident leaves child with traumatic brain injury

New York – The driver of a car in Nassau County, Long Island apparently hit a pedestrian as she was crossing the street over the weekend. The victim, only 10 years old, was struck by a car and suffered a severe head injury. She was rushed to the emergency room of a hospital and listed in critical condition according to doctors. The accident victim was diagnosed with a traumatic brain injury but it is unclear how much brain function was affected. The car accident in under investigation, with investigators looking into the mechanical functioning of the car as well as the actions of the driver.

Trauma specialists explain that a head injury can cause a concussion, loss of consciousness and intracranial hemorrhage. Each of these may be classified as a traumatic brain injury and further investigation and treatment is crucial. $990,000 Worker’s Compensation Settlement – Electrician injured hip and pelvis on the job

Mr. Sabet, an electrician in New York City, worked for a contractor when he suffered an injury to his hip and pelvis. His on- the job injury required two orthopedic surgeries and extensive physical therapy.
