New York State’s Mandatory Personal Injury Protection Insurance

New York – One the essential components of car insurance in NYS is the personal injury protection (PIP) coverage. It is mandatory to ‎have at least some basic level of this insurance as part of your car insurance in this state. Many don’t ‎truly understand the meaning of this insurance unfortunately until they’re in a car accident with ‎injuries. A sudden car crash inevitably takes you by surprise and the injuries can vary from minor to life ‎threatening in mere moments. The insurance coverage provided for accident injuries covers both the ‎driver and passengers in the vehicle during the collision. It likewise may also cover you if you’re ‎involved in a pedestrian accident, but this should be discussed with a professional, dependant on ‎details of the motor vehicle accident (MVA). It is important to note that a covered injury from an MVA ‎is paid for regardless of whether or not you have health insurance. Additionally, this coverage is ‎helpful when the other car or truck is driven by either an uninsured driver or underinsured motorist. A ‎top New York accident lawyer notes that your PIP insurance ‎can guarantee that your injuries and medical treatment will be covered, up to the policy limits, ‎regardless of who caused the accident. Some injury victims find it necessary to file a personal injury ‎lawsuit in order to help compensate them for their MVA injuries and help get the needed treatment ‎and payments. You can read more details about New York’s PIP insurance requirements here.

Police officer injured in on-the-job pedestrian accident

New York – A Long Island police officer was injured at work when he was hit by a car on the highway. The cop, working for the Suffolk County ‎Police Department, was working on the side of the highway investigating an unrelated car crash. His ‎investigation soon turned into a second car accident when a pick-up truck crashed suddenly into his ‎police cruiser, then crushing into the policeman. The injured officer suffered a severe head injury with ‎traumatic brain injury (TBI) during the pedestrian accident. The TBI included a traumatic intracranial ‎hemorrhage according to officials. The accident victim was taken in for emergency brain surgery to ‎reduce swelling from the brain bleed and he remained on a ventilator in a medically induced coma. He ‎was also evaluated for neck and back spinal injuries as well as additional wounds from the truck ‎collision. Work injuries like this need to be covered by workmen’s compensation insurance and not ‎usually by traditional health insurance in New York State. The injured worker will certainly require long-‎term care and monitoring if he is able to be successfully weaned off of the ventilator. Details of his ‎work accident injuries will become more clear as time progresses. To read more about this police on-‎the-job accident at work, see this article.‎

Record numbers of bicycle accident deaths in New York

New York – Work safety researchers have compiled statistics on NYC bicycle accidents and pedestrian ‎accidents. They note that there has been a significant increase in the numbers of ‎accident deaths during the past year of COVID-19. Theories as to why the increased bike crash and ‎pedestrian injuries have occurred during this time period abound. Amongst the discussions is the fact ‎that collisions caused by speeding have risen and the sheer increased numbers of bikers on the road ‎have been clearly documented. Often these injured bicyclists were delivery men and women who ‎were involved in a car accident while at work. The bike accidents usually cause personal injury but all ‎too often end in wrongful death according to reports. Worker’s compensation insurance is supposed ‎to cover injuries sustained in an on-the-job accident such as this but some injured workers find it ‎difficult to obtain proper care. Some work injury victims find it necessary to get help from a worker’s ‎comp lawyer that can assist them in filing paperwork and sometimes even filing a injury lawsuit. ‎Further information about the increased bike accidents and deaths is available here.

Injured accident victims when a jeep crashes into a storefront

New York – A bagel store in Westchester was the scene of a surprising car crash that left at least three injury victims. The driver of a jeep was apparently leaving the parking lot, having been parked in a spot directly in front of the restaurant in New Rochelle, NY. It is believed that the driver became confused when he put the car into drive instead of reverse and then pressed the gas. This caused the driver to lose control of the vehicle and slam into the storefront and hit several pedestrian workers in the store. It ripped apart the entire front of the store when the vehicle jumped the curb and drove through the front glass wall. The pedestrian accident left the workers injured and in need of emergency evaluation for unclear wounds. The injured workers were not the only ones who suffered wounds during the motor vehicle accident (MVA), as the driver of the vehicle also suffered accident injuries. The injured workers will likely be treated using their worker’s compensation insurance, also referred to as worker’s comp. However, in certain circumstances such a car collision at work is treated using the car insurance policy. See this article for further information about this MVA.

Manhattan car accident injured police officer in Smart Car

New York – An NYPD officer suffered neck and back injuries due to a car crash in a city park. The car collision occurred in Washington Square Park when a reckless driver slammed into the concrete barriers that were placed there to protect pedestrians in the park. Police report that the driver of the car lost control for an unknown reason and hit the bollards. His vehicle then slammed into a parked NYPD Smart Car injuring the officer. The cop will require additional evaluation and treatment for his spinal injury. Doctors explain that this kind of accident injury can cause permanent disability with broken bones or fractures, herniated disc or even spinal cord or other nerve damage. The initial investigation has raised suspicion that the cause of this police car accident was a drunk driver of the other vehicle. Bystander reports show that the man jumped the curb and slammed into an area where vehicles are forbidden from driving. In fact, the location had concrete traffic barriers placed for the very purpose of preventing another deadly pedestrian accident as occurred in that park years ago. See this article for more about this accident with injuries.

New York City a dangerous place for bicyclists

New York – Bicycle accidents are a known hazard for bikers, pedestrians and motorists alike. Unfortunately, bike crash incidents occur all of the time on the busy city streets, causing serious accident injuries and even wrongful deaths. Public safety advocates say that the city, police and many drivers share negligent responsibility for these accidents. They believe that the proper steps to secure the roads are not taken despite the known hazardous condition created for innocent bicycle riders that also need to share the roads. This is how many get to work, do deliveries, make their way to shopping and overall just get around. Activists contend that department of transportation officials must do a proper job of designing safe streets, maintain roads and parking zones according to basic safety standards and must identify and repair known danger zones. Negligent maintenance is an obvious safety hazard that should be addressed by city officials. In addition, NYPD police officers have a responsibility to actively make the streets safer by stopping and ticketing or towing dangerous drivers and keeping bicycle lanes open and clear of illegally parked cars and trucks. This can prevent bike versus car accidents. The sanitation department also shares responsibility to maintain clean and safe streets and bike lanes without dangerous debris that can lead to a collision or injury. This article shares more about the dangers and difficulties that often lead to bicycle and pedestrian accidents.

Bicycle accident responsible for another preventable traffic fatality

New York – Yet another bicyclist died in a bike crash in Brooklyn. The rider was hit by a car during a car crash that caused serious injuries. The bicycle rider apparently had gone through an intersection with a stop sign and was struck by the car. He sustained a severe head injury with and was taken to the hospital. Details regarding the nature of his accident injuries are unclear but he apparently suffered a traumatic brain injury (TBI). Hospital officials report that the injured bicyclist was treated for his injuries for several days but ended up dying from those wounds. It is believed that the brain damage, or TBI, caused by the car accident left the man critically injured and certainly contributed to his death. Other internal injuries or bleeding has not been fully ruled out at this point.

New York City traffic safety advocates say that this was yet another preventable traffic accident. They believe that this car crash led to the wrongful death of the rider. The responsibility to create and maintain safe roads, including bicycle lanes, is the responsibility of the city transportation board. Some feel that they have not done enough to build and properly maintain acceptable safety standards in order to protect pedestrians, bicyclists and motorists. They note that drivers need to have clear designations as to where to drive and how to maintain safety in order to protect others sharing the roads. Clear road signs are not always present or visible. At the same time, road maintenance crews must be dispatched to fix damaged and dangerous sections of road and intersections. Some feel that negligent maintenance has created a hazardous situation for everyone on the road. You can check out more about this bicycle crash and another deadly pedestrian accident here.
